Hyattsville is unique because both the District Court of Maryland for Prince George’s County and the Hyattsville Police Department share the same property on Rhode Island Avenue (U.S. Route 1). Our firm regularly represents clients at that courthouse, defending charges that begin from traffic stops along Route 1, Decatur Street, and MD 201 (Edmonston Road), where DUI arrests are especially common.
Located just minutes from the University of Maryland at College Park and neighboring communities such as Greenbelt, Riverdale Park, Hillandale, Mount Rainier, Brentwood, and Queen’s Chapel, Hyattsville sees a high volume of traffic enforcement. Drivers coming off the Capital Beltway (I-495) onto Route 1 or Kenilworth Avenue often encounter saturation patrols and DUI checkpoints.
If you are coming from Silver Spring, take Georgia Avenue south to the I-495 interchange, follow the Beltway east toward College Park, and exit onto U.S. 1 southbound. The courthouse and police department are just past Decatur Street on the right-hand side. It is one of the most active DUI jurisdictions in Prince George’s County, and experience in that courtroom matters.
Police Jurisdictions Operating in Hyattsville
Several law enforcement agencies have overlapping jurisdiction in and around Hyattsville. The Prince George’s County Police Department handles most local traffic and DUI arrests. The Hyattsville City Police Department and the Maryland–National Capital Park Police patrol the city and nearby parks, while the U.S. Park Police enforces laws on and around the Baltimore–Washington Parkway (BW Parkway). The BW Parkway is federal property, so any DUI occurring there is actually a federal offense.
Federal DUI Defense on the BW Parkway
A DUI on the BW Parkway is prosecuted in the United States District Court for the District of Maryland at Greenbelt. Because it is federal property, these cases fall under the Assimilative Crimes Act, which essentially adopts Maryland state DUI laws for federal jurisdiction. However, the procedures and negotiations in federal court differ substantially from those in state court. Our attorneys are fully licensed in federal court and have extensive experience defending federal DUI cases.
In federal DUI cases, judges generally apply Maryland’s statutes and penalties, but the Assimilative Crimes Act adds another layer of complexity. The federal system does not have an exact equivalent of Maryland’s “probation before judgment,” yet experienced federal DUI counsel can often negotiate dismissals or favorable resolutions. It is frequently possible to persuade an Assistant U.S. Attorney to dismiss a case when the defendant’s alcohol level was not extreme and no aggravating circumstances were involved, such as an accident, a child in the vehicle, or reckless speeds. Understanding what federal prosecutors require to consider dismissal can make the difference between a permanent federal record and a clean slate.
