Understanding DUI & DWI in Maryland

Maryland’s drunk and drugged driving laws live in Transportation §21‑902. DUI under §21‑902(a) applies at 0.08% BAC or substantial impairment; DWI under §21‑902(b) applies around 0.07% or observable impairment. Sections (c) and (d) cover drugs and CDS; (e)–(h) address commercial drivers and repeat‑offense enhancements.

Ignition Interlock (Noah’s Law) may be mandatory after conviction; voluntary early enrollment can preserve driving for some drivers.

MVA Hearings

You have 10 days to request an MVA Hearing to keep full privileges while your case is pending. After day 10 (but within 30 days) you can still request a hearing, but suspension may begin after day 45. At the hearing, an ALJ reviews whether the stop, testing, and implied‑consent procedures were lawful.

Breath & Blood Testing

Breath: Maryland uses the Intoximeter EC/IR II to estimate BAC from breath alcohol. The estimate relies on assumptions about partition ratio, temperature, breathing patterns, and absence of mouth alcohol.

Blood – Alcohol: Hospital draws may use alcohol swabs, which can contaminate the sample and inflate reported BAC. Samples must be preserved with proper chemicals and sealed to prevent fermentation that can raise the number over time.

Blood – Drugs: Drug blood tests detect metabolites, not real‑time impairment. Prosecutors often pair these results with a police‑certified Drug Recognition Expert (DRE). Whether DRE testimony is admitted varies among Maryland circuit courts; under the new Daubert standard, a skilled defense can block DRE expert qualification if the methodology isn’t scientifically reliable.

Drug Recognition Experts (DRE) under Daubert

The DRE program began in the early 1980s with the Los Angeles Police Department and later spread nationwide through NHTSA and Maryland police academies. DREs use a 12‑step protocol (vitals, eye movements, muscle tone, divided attention) to opine on drug impairment. Because the process relies heavily on subjective observation rather than validated laboratory science, Maryland courts in different circuits have split on admitting DRE opinions as expert evidence.

Since the Supreme Court of Maryland adopted Daubert, trial judges must ensure expert opinions are grounded in tested, peer‑reviewed, and generally accepted methods. In many cases, DRE methodology fails those criteria. A focused Daubert challenge can prevent DRE expert designation and substantially weaken a drugged‑driving prosecution.

Noah’s Law (2016–2025)

  • 2016: Mandatory ignition interlock after DUI conviction; enhanced penalties for refusals.
  • 2018: Tighter interlock calibration and reporting.
  • 2024: Expanded voluntary interlock eligibility for certain first‑time DWI cases.
  • 2025: Digital MVA hearing requests; recognition of certain out‑of‑state DUIs for enhancement; increased penalties for interlock tampering.
